Do Everything You Want to do on the Internet on Jazzd Interactive

Introduction-Haywire provides its technical support services, as they may exist from time to time ("Services"), to users who pay a service fee to subscribe to the Services. By purchasing and/or using the Services, Customer agrees to be bound by this Agreement and to use the Services.
If Customer does not agree to the terms and conditions of this Agreement, including any future revisions, Customer may not use the Services and if Customer is a current Subscriber, Customer must terminate its use of the Services.

Customer Requirements-Customers must be at least 18 years old. By ordering the Service, Customer confirms that he/she is an adult of at least 18 years of age. Customer further agrees to have present an adult, age 18 or older and no unattended minors while Technician is working in Customer’s home.
Customer confirms that he/she has completed a back up of all software and data that is stored on his/her computer’s hard drive(s) and/or any other storage devices before Haywire can perform Services. Haywire is not responsible for loss, alteration or corruption of data, software or files that may result from the performance of the Service by our Technicians. Customer confirms that all computers connected to the network have a minimum Operating System of Windows 98 or higher, Mac OSX10.3 or higher or Ubuntu 7.04 or higher. Customer hereby grants Haywire permission to access and modify Customer’s computer, computer settings and any related software or peripheral equipment, including data, software and hardware componmedents, in order to perform the Services.
By signing this Work Order and permitting the Technician to perform the agreed Services to be performed in Customer’s home, Customer represents and warrants that he/she is the rightful owner of the property in or on which the Services are to be performed.

Payment Obligations of Subscribers-Customers must a) provide Haywire with accurate and complete billing information including legal name, address, telephone number, and credit card/billing information, and b) report to Haywire all changes to this information within 30 days of the change. Customers are responsible for any charges to their account. Customers having questions regarding charges to an account should contact Customer Service at 1-877-442-9947. All charges are considered valid unless disputed in writing within 60 days of the billing date, by notice to Haywire at its above email or state address. Adjustments will not be made for charges that are more than 60 days old.

Disclaimer of Warranties and Limitation of Liability-THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS. HAYWIRE MAKES NO WARRANTIES REGARDING THE SERVICE. HAYWIRE AND ITS EMPLOYEES ARE NOT LIABLE FOR ANY COSTS OR DAMAGES ARISING DIRECTLY OR INDIRECTLY FROM CUSTOMER’S USE OF THE SERVICES INCLUDING ANY INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. IN ANY EVENT, HAYWIRE’S CUMULATIVE LIABILITY TO ANY CUSTOMER FOR ANY AND ALL CLAIMS RELATING TO THE USE OF THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF SERVICE FEES PAID.

Indemnification-Customer agrees to defend, indemnify and hold harmless Haywire from any and all liabilities, costs and expenses, including reasonable attorney’s fees, relating or arising from the use of the Service.

Term of Agreement-Continued use of the Services constitutes acceptance of this Agreement, its terms and conditions, as well as any future versions. If Customer is dissatisfied with the Services or any related terms, conditions, rules, policies, guidelines or practices, Customer’s sole and exclusive remedy is to discontinue using the Services.

Jurisdiction-This Agreement is governed by Pennsylvania law without regard to conflict of law provisions. The federal and state courts located in Pennsylvania alone have jurisdiction over all disputes arising out of or related to this Agreement, its terms and conditions, and the Services. Customer consents to the personal jurisdiction of such courts sitting in Pennsylvania with respect to such matters or otherwise between Customer and Haywire, and waives Customer’s rights to removal or consent to removal.

Miscellaneous-This Agreement, its terms and conditions, the Acceptable Use Policy, the Privacy Policy, and Haywire other user policies posted on D&E Communications Website constitute the entire Agreement between Customer and Haywire with respect to Customer’s use of the Services.

Haywire may revise, amend or modify this Agreement, its terms and conditions, the Acceptable Use Policy and any other user policies and agreements, at any time and in any manner. Notice of any revision, amendment or modification will be posted on Haywire's Website.
